NOTICE TO CEASE AND DESIST INTERNET DEFAMATION AGAINST THE WRITE AGENDA

Dear Author, Rita Webb:
Please be advised that our law firm has been advised to take possible legal action against you for the series of defamatory attacks made by you against The Write Agenda on the web site “Rita’s World” and other affiliated web sites.
You have posted many willfully false and misleading comments about The Write Agenda. Examples of your defamatory statements have been sent to our law firm and include the following:
“I am happy to hear The Write Agenda is under investigation.”
Also, the following posting by Ann Crispin:
“Writer Beware (singular, btw) believes the motivating force behind this hate site is a scammer who had his defamation lawsuit against Writer Beware dismissed a couple years ago. In his dismissal decision, Massachusetts Judge Thomas Connelly openly said that this individual and his companies were committing “fraud.” Writer Beware (singular, btw) believes the motivating force behind this hate site is a scammer who had his defamation lawsuit against Writer Beware dismissed a couple years ago. In his dismissal decision, Massachusetts Judge Thomas Connelly openly said that this individual and his companies were committing “fraud.” They’re currently under investigation and facing a civil suit from the Florida Attorney General’s Office for fraud and conspiracy to commit same.”
For the record, The Write Agenda is not under investigation, is not the individual identified by Ann Crispinand is not affiliated with the individual identified by Ann Crispin. The statements made in reference to The Write Agenda are false and without merit and are defamatory per se.
Additionally, your comments and posts actively encourage and solicit defamatory statements from users of various internet sites. You could have serious financial exposure to The Write Agenda for each and every single defamatory statement. Your conduct of spreading libelous and defamatory statements and comments about The Write Agenda have caused serious and irreparable injury to our business and reputation within the publishing and author community.
While you certainly have a right to express your opinions, you do not have the right to make false statements of fact injurious to another’s reputation. The comments posted by you on The Write Agenda go far beyond the mere expression of opinion. They are false statements of facts that have damaged The Write Agenda’s business and reputation.
THEREFORE, we hereby demand that you:
1. Immediately CEASE AND DESIST from making defamatory comments against The Write Agenda on any and all web sites, including, but not limited to “Rita’s World.”
2. Immediately delete or remove from “Rita’s World” and any other web site, all defamatory and disparaging remarks made by you against The Write Agenda.
If you refuse to comply with our demands within 1 week (September 2, 2011) of receipt of this letter, The Write Agenda will have no choice but to pursue all legal claims against you, including the filing of a lawsuit. In that lawsuit, we will pursue not only damages caused by your actions, but attorney’s fees and court costs.
Please be advised that this letter is copyrighted by our organization, and you are not authorized to republish this in any manner. Use of this letter in a posting, in full or part, will subject you to further legal causes of action.
